Terms of Service

Draft notice: This document is provided for use by Field Pulse customers and should be reviewed by legal counsel before relying on it for commercial purposes.

1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of the Field Pulse platform, mobile application, and related services (collectively, the “Service”) operated by MCS Ventures (“we”, “us”, or “Field Pulse”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms on behalf of yourself and your organization.

2. The Service

Field Pulse is a Field Force Management platform that provides attendance tracking, location-based check-ins, order management, client visits, expense reporting, task assignments, and related workflows for sales and field teams. The specific features available depend on your subscription plan.

3. Account Registration

To use the Service, you must register an organization account and designate at least one administrator. You are responsible for:

  • Providing accurate, current, and complete information during registration
  • Maintaining the confidentiality of login credentials for all users in your organization
  • All activity that occurs under your account, whether by administrators, managers, or field employees you have invited
  • Promptly notifying us at support@fieldpulse.mcsventures.in of any suspected security breach or unauthorized access

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service, including probing for vulnerabilities without prior written permission
  • Spoof location data, falsify attendance records, or misrepresent any data collected or reported through the Service
  • Use the Service to track individuals without their informed consent, in violation of local privacy laws
  • Resell, sublicense, or commercially exploit the Service without our written consent

5. Subscription, Trial, and Billing

Field Pulse offers a free trial period as specified at registration. After the trial ends, you must upgrade to a paid subscription to continue using the Service. Paid subscriptions are billed monthly in Indian Rupees at the per-user rate disclosed at the time of upgrade, plus applicable Goods and Services Tax (GST).

Billing details:

  • Active users at the start of a billing period are charged in full for that period
  • Users added mid-cycle are charged on a prorated basis from the day they are added through the end of the current period
  • Users removed mid-cycle do not receive refunds; see our Refund Policy
  • Payments are processed securely via Razorpay. We do not store your card details on our servers
  • Failed payments enter a 48-hour warning window, after which field employees lose access until payment is restored

6. Data Ownership and Privacy

You retain all rights to the data you and your users upload to, or generate through, the Service (“Customer Data”). We act as a data processor on your behalf. Our collection, use, and safeguarding of Customer Data is described in our Privacy Policy, which is incorporated into these Terms by reference.

You represent that you have obtained all necessary consents from your employees and other data subjects to process their personal data — including location and attendance data — through the Service, as required by applicable law.

7. Service Availability

We aim for 99% monthly uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance where practical. We are not liable for downtime caused by factors beyond our reasonable control, including internet outages, infrastructure provider failures, or acts of force majeure.

8. Intellectual Property

All rights, title, and interest in and to the Service (excluding Customer Data) remain the exclusive property of MCS Ventures. These Terms do not grant you any ownership rights in the Service, trademarks, or other intellectual property.

9. Termination

You may cancel your subscription at any time from the billing page. Your access will continue until the end of the current paid period, after which the subscription will not renew. We may suspend or terminate your account with notice if you violate these Terms, fail to pay, or engage in abuse of the Service.

Upon termination, you may request an export of your Customer Data within 30 days. After 30 days, we may permanently delete your data.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, MCS Ventures’ total aggregate liability arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to us in the twelve months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email to the account administrator at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
